This Privacy Notice (the “Privacy Notice”) serves to inform you of our policies and procedures regarding the collection, use and disclosure of the information we receive when you access and use the website (the “Site”), services, software, mobile applications, content, and all other products and services (all of the foregoing collectively, the “Services”) referencing this Privacy Notice. We are Times Internet (UK) Ltd., d/b/a Willow by Cricbuzz and its affiliates, and subsidiaries (together with its affiliates, subsidiaries and related companies, “Willow by Cricbuzz,” “we,” “us,” or “our”) with offices at 650 Castro St, Suite 120-214, Mountain View, CA 94041. With respect to the Services, we are the data controller. We believe that the privacy of our users is paramount and strive to use Personal Information (as defined below) only in ways outlined in this Privacy Notice. The Privacy Notice is incorporated by reference into our Terms of Service, currently available here (the “Terms of Service”). Any terms used herein and not defined will have the meanings given to them in the Terms of Service.

  1. What We Mean by Personal Information

    For purposes of this Privacy Notice, “Personal Information” means any information from or about a person that either identifies that person directly or that makes that person identifiable when it is combined with other information from or about that person from any source.

  2. Information We Collect

    Information You Provide To Us

    When you use the Services or otherwise communicate with us, we collect any and all information that you provide to us directly. For example, we collect information in the following circumstances when you: (i) use our Site or App, (ii) register for the Services or create an account or profile or accept the creation of an account or profile on your behalf (an “Account”), (iii) access the Services through social networking sites or third party services, (iv) subscribe to newsletters; (v) purchase a product or service on the Site or in our App; (vi) invite your friends to join the Services, “share” the Services on social networking sites or perform other similar actions; (vii) request technical support; (viii) otherwise use our App or Services where Personal Information is required for such use and/or participation, (ix) when you sign up for a newsletter, and (x) when you contact us via the Site, App or when you otherwise communicate with us. You can choose not to provide information that is requested of you by us; however, this may limit your ability to use or access the Services.

    The information you provide to us directly may include, without limitation, the information that may, alone or in combination with other data, constitute Personal Information, as follows:

    • Information you provide in connection with creating an Account, subscribing to our Services, including your first and last name, e-mail address, phone number, postal address, username, password, your image, if you choose to upload any photos to the Services, approximate geo-location, pin code or area code, and any other information you decide to provide;

    • Information you provide while completing a transaction or purchase using the Services, including the amount paid and type of orders, services and products requested or purchased, shipping information (including your physical address), subscription information and purchase history.

    • Information you provide via email, through the “Contact Us” section on the Site or App or by using the contact details listed on various parts of the Site or App, or during contests, sweepstakes, promotions and surveys, including your name, e-mail, phone number, inquiry, reviews, and survey or contest responses or submissions and any other information you decide to provide;

    • Information you provide in order to subscribe to our newsletters and updates, including your email address, the topic for which you wish to receive updates, or any other information you decide to provide us with. You may opt out of receiving updates and other emails from us at any time by following the unsubscribe instructions in the applicable email or by contacting us using the contact information provided below under “Contacting Us.” Note that, even if you opt out of receiving promotional communications from us, you may still receive administrative communications from us with respect to your use of the Services;

    • Information you provide in order to apply for a position or opportunity with us, including your name, contact information, resume, job application, or related materials. We may use that information to evaluate your qualifications and consider or respond to your inquiry or application. Your submission of a resume, job application, or related information does not in any way require us to review that information or consider you for employment;

    • Transaction and limited (non-PCI) payment data including your first and last name, payment card information, billing information, and mailing address. We do not store payment card numbers on our systems. The payment-related information you provide is handled by our third party payment processing systems (‘PSP’) in accordance with their privacy policy. We encourage you to review the PSPs posted terms and privacy policies. This Privacy Notice does not apply to such third party’s collection and use of your information. For more information, please see the ”Payment Information” section below; and

    • Any other information you may want to share with us, such as Personal Information related to recruitment / job applications.

    Moreover, if you contact us, a record of such correspondence may be kept.

    When you provide us with the personal information of third parties, such as your friends, family or others, it is your responsibility to inform them about the processing of their personal information in accordance with this Privacy Notice, and to confirm that they have given their permission, where necessary.

    You can choose not to provide us with any or all of the information we specify or request, but then you may not be able to register with us or to take advantage of some or all of the Services.

    Automatically Collected Information

    Most of the data we collect in and through the Services is technical in nature and is collected and processed automatically through application programming interfaces, software development kits, and similar software-based technologies, and tracking technologies (i.e., cookies, pixel tags, web beacons, clear GIFs, or similar tracking technologies). Alone or in combination with other data, such automatically collected data may constitute Personal Information. The data we may collect by automated means may include, without limitation:

    • Device Data and other Technical Information: The servers used to operate and provide the Services, as well as our third-party service providers, may collect data including, but not limited to, data and information about your hardware, operating system, device’s screen resolution and web browser type, browser settings, your mobile carrier, or internet service provider, and unique ID’s and identifiers associated with your device, including IP address, and location data.

    • Viewing Data:. We may collect information about your video viewing, search history, and watch preferences and history. We may use your Viewing Data to provide you personalized recommendations and to personalize the Services provided to you. We may also use Viewing Data to provide you with announcements of new products and title availability on the Services. We may share connection and usage information about you along with a hashed or masked identifier (contact information) with third parties, such as partners and social networks, to inform the offers we send you and for advertising measurement or analytics. With your appropriate consent when required, and consistent with applicable law, we may disclose your Viewing Data to third parties, including service providers, advertising companies, analytic partners, and social media sites.     • Network and Internet Information: including, but not limited to, URLs, Internet Protocol addresses, bounce rates, use of spoofing, active (TCP/IP) ports, number of sessions initiated, the websites you access before and after visiting the Services, the length of time you spend on the Services, date and time stamps, click streams, location information, performance statistics, and network/Wi-Fi access points.

    • Usage Data: including but not limited to webpages, apps and ads you see and interact with, search terms entered, mouse clicks, mouse movements, page scrolling, and pages viewed, data reflecting transactions that have taken place using the Services, how you interact with other users, performance statistics, and other usage data.

    We may use, depending on the Services, (i) location based on the IP address presented by you and (ii) network-based geo-location data based on proximity of network towers or the location of Wi-Fi networks. Please note that disabling location service will not anonymize data already collected and uploaded to our servers.

    Analytics

    The Services may use third-party analytics tools (e.g., Google Analytics) to collect and process data about your use of the Services, including when you visit the Site, URLs of the websites that you visit prior to visiting the Services and when you visit those websites, and IP addresses assigned to the devices from where you access the Internet. Our analytics providers may set and read tracking technologies to collect this data and your web browser and/or device will automatically send data collected by those tracking technologies to our analytics providers. Our analytics providers use this data to provide us with reports that we will use to improve the Services’ structure and content.

    Personal Information obtained from Third Party Sources

    From time to time the Services may obtain personal information (e.g. demographic information) from third-party marketing partners, publicly-available sources, and data providers. and we may combine such data with Personal Information.

    The Services may include links to third party websites and social media platforms where you will be able to post comments, stories, reviews, images, recordings or other information on such third party websites. Your use of these third party websites and social media services may result in the collection or sharing of information (such as contact information controlled by that service or as authorised by you via your privacy settings on that service) about you by these third party websites (such as when you link, connect or log in through a third party service like Google or Apple) and social media platforms, whether through tracking technologies, registration information, or otherwise. Third party websites and social media platforms may track your online activity even when you do not choose to interact with the website, social media platform or its widgets or other features. We encourage you to review the privacy policies and settings on the third party websites and social media platforms with which you use or interact to make sure you understand the information that may be collected, used, and shared by those third party websites and social media platforms, as those websites and platforms’ respective privacy policies will govern their collection, use, and disclosure of information they collect from you. We cannot control any policies or terms of such third-party websites or platforms. As a result, we cannot be responsible for any use or disclosure of your information of content by third party websites or platforms, which you use at your own risk.

    You hereby acknowledge that Willow by Cricbuzz makes no guarantee that exercising the foregoing options is guaranteed to prevent applicable third-party websites and social media platforms from tracking you and, further, you acknowledge that Willow by Cricbuzz is not responsible for a third party website or social media platform’s tracking of you.

    Information You Post on the Services

    We will collect all data, information, and other content that you enter into, submit to, upload to, or transmit using our Services (i.e., user-generated content). The Services may provide chat, forum or bulletin board tools to users and or other customized profile and Account information. You are responsible for any and all text, images, video, audio, comments, data, information, and other content and material that you submit, create, post, upload, embed, display, communicate, distribute, or transmit using our Services and all such content and material are provided at your own risk. This includes any content or material provided that is intended to be made accessible or viewable by other users of our Services, including, as applicable, the general public. We cannot guarantee that such user-generated content will not be viewed by unauthorized persons. We have no obligation to keep private any user-generated content that you disclose to other users or the public using these functions. You understand that, even after removal, copies of user-generated content you have provided may remain viewable in cached and archived pages and may have been copied or stored by Internet archives and other users of the Services. We will make user-generated content available to other users of the Services and to the public, as applicable, and will use and disclose user-generated content for the purpose for which it was provided (including as may be indicated at the point of collection).

    You should exercise caution when deciding to disclose Personal Information through the use of these tools or functions. We strongly recommend that you do not post any information through the Services that allows strangers to identify or locate you or that you otherwise do not want to share with the public.

    Payment Information

    Payments submitted in connection with the Services must be made via the Services by credit, debit card, or through alternate payment methods (such as Apple AppStore, Stripe, Roku, Samsung AppStore, Amazon Fire TV etc.) where such alternate payment methods are made available as an option. Please note that alternate payment methods may be provided by third parties (e.g., Google Pay via Google), subject to that third party’s privacy policy. This Privacy Notice does not apply to such third party’s collection and use of your information. Please review the applicable third party’s privacy policy. With regard to credit and debit card payment, all credit and debit card information is provided directly to our third-party payment processor. We do not directly access, handle, or store your credit or debit card information. To submit payment using the Services, you will need to provide your name, email address, telephone number, and your credit or debit card number, expiration date, and security code, as well as any such information as necessary to verify the applicable payment. Our payment processor will use your payment-related information in accordance with its privacy policy. Where online storefront on the Services is hosted or powered by a third party, we encourage you to review any posted terms and privacy policies.

  3. Use of Collected Information

    We use Personal Information that we collect for the following purposes: (i) to further our legitimate interests in providing the Services, including without limitation, to collect and remit payment for paid features, (ii) to administer your use of the Services and any Accounts you may have with us, (iii) to personalize your experience, (iv) to provide to you Service announcements or inform you of new releases and features, (v) to provide you with further information and offers from us or third parties that we believe you may find useful or interesting, such as newsletters, marketing or promotional materials, (vi) to perform tasks on behalf of and according to instructions of a third party, such as payment processors, third party-service providers or our advertising partners, (vii) to enforce our Terms of Service, (viii) to resolve any disputes between users of the Site and/or App or between such users and us, (ix) comply with applicable law, or a legal or regulatory requirement, request or process, including, but not limited to, civil and criminal subpoenas, court orders, law enforcement requests, governmental agency requests, emergency services, or other compulsory disclosures; (x) to further our legitimate interest in protecting our rights, property, safety, and security and the rights, property safety and security of the Services, our users or the public, (xi) to model, segment, offer market and advertise our Services including direct marketing (email and SMS) and interest based advertising - except where consent is required, we undertake such marketing and advertising on the basis of our legitimate business interest to use your personal information for the purposes described above. Where we rely on your consent, you may withdraw your consent at any time, including by following the opt-out instructions in the “Methods for Submitting Requests and Our Response to Requests” section below, (xii) for Contests, Sweepstakes, Promotions and Surveys - where we intend to publish your survey responses or reviews with information that identifies you, we will ask you for your consent to be able to process this information; and (xiii) to contact you to obtain feedback from you regarding the Site and/or App and the Services.

    In addition to the purposes described above, we use the information collected automatically to: (i) further our legitimate interests in monitoring, measuring and analyzing the use of the Services and for the technical administration of the Site, (ii) operate, improve and develop the Site, App and the Services, (iii) generate and derive useful data and information concerning the interests, characteristics and website and application use behavior of our users, and (iv) verify that users of the Services meet the criteria required to process their requests. We and or our advertising partners may use demographic and geo-location, as well as information logged from your hardware or device, including data such as IP address, device model and ID, MAC address, operating system, application usage data, device time zone, region and language, and click ID, to ensure relevant advertising is presented within the Services.

  4. Third Parties We Share Personal Information With

    We may disclose Personal Information you provide to us or that we collect automatically on the Site and/or App and in and through the Services with the following categories of third parties:

    • Business partners. We work with a number of partners who help us offer our Services, such as streaming platform providers. We may share information collected from or about you with such partners, such as name, email address, and Services interacted with and/or purchased.

    • Social network services. When you choose to share information with social networking services about your activities on Willow by Cricbuzz, information about you and your activities will be shared with that social network.

      • Sharing with Facebook. If you visit Willow by Cricbuzz while logged into Facebook, then Facebook may be able to identify your browser and associate technical information provided by your web browser with other information that Facebook already has about you. Facebook may make that information visible to Facebook users in accordance with applicable law, Facebook’s data policy, and your Facebook privacy settings. We recommend that you familiarize yourself with Facebook’s data policy and privacy controls.

    • Service providers, such as payment processors, marketing service providers, subscription management and billing service providers, communication service providers, analytic providers, and web hosting and data storage service providers helping us deliver and develop the Services. Our service providers are authorized to and may use and disclose your information as necessary for them to provide the applicable products and services to us and as provided by their own privacy policies and our agreements with the third parties.

    • Advertising partners. We may share information collected from or about you with advertisers and service providers that perform advertising-related services for us and our business partners in order to tailor ads and/or campaigns and measure their effectiveness. This information may include, but is not limited to, the use of our Services, the websites you visit, ads you viewed, and your other online activities.     • Audience measurement providers. At times, our business and advertising partners seek to measure the performance of their content across our Services. Accordingly, we may permit the use of third-party measurement software that enables third parties (such as Nielsen) to include your viewing of our Services in calculating measurement statistics such as TV ratings.

    • Legal & Law Enforcement Authorities. We may disclose information collected from or about you in response to a legal or regulatory process, such as a court order, subpoena, or in response to a law enforcement or regulatory agency request, if legally required to do so. We may also disclose information to authorities for fraud prevention, to investigate or prevent illegal activities, and to protect our rights and safety or the rights and safety of third parties.

    • Affiliates Subsidiaries, and Related Entities (Including Cricbuzz Platforms Limited). Based on how you use the Services and the information that you provide to or request from us, we may disclose Personal Information, including your personal information, with our affiliates, subsidiaries and other related entities (collectively, “Related Entities”). By providing us your Personal Information and using the Services, you hereby direct us to disclose your information to our Related Entities. Our Related Entities may contact you directly with respect to products and services, provided that if applicable law requires, your prior consent will be obtained. You may opt out of receiving communications from any such Related Entity pursuant to that Related Entity’s own policies.

    • Business Transactions. Our subsidiaries and affiliates; or a subsequent owner, co-owner or operator of the Site and/or App, and the Services and their advisors in connection with a change in control, acquisition, merger, consolidation, restructuring, the sale of substantially all of our stock and/or assets, or in connection with bankruptcy proceedings, or other corporate reorganization, in accordance with this Privacy Notice. We may also disclose information collected from or about you in connection with the evaluation of those transactions. The subsequent owner(s), operator(s), successor(s), and other recipients will be bound by this Privacy Notice as it applies to the information disclosed.

    • Intra-Group Sharing. Times Internet Inc.[a subsidiary of Times Internet limited] operates a centralized data system to enhance collaboration and operational efficiency among its various commonly owned group companies, some of which may be expressly branded as Times Group companies, while others may utilize independent brands. This platform consolidates user data, such as personal information and subscription details, from different services offered by affiliated companies. The purpose of this data sharing is to enable cross- selling and upselling opportunities, improve customer insights, and streamline service offerings across all affiliated entities. By pooling data into a shared system, an affiliate company delivers personalized services and targeted marketing, thereby increasing customer engagement, retention, and revenue growth. The types of data shared with the centralized data system include personal identifiers such as names, phone numbers, email addresses, and location details. It also includes information about subscription plans, such as whether they are paid, free, or trials, along with the start and end dates of those plans. Additionally, the platform tracks user behavior, including whether the customer is a repeat user and the specific services or plans they subscribe to. This shared data allows affiliated companies to analyze customer preferences and usage patterns, enabling them to offer complementary services and personalized recommendations. This intra-group data sharing initiative improves the customer experience by offering more tailored services, supports business development through targeted marketing, and enhances operational efficiency across Times group entities. We maintain a commitment to addressing legal and privacy considerations to ensure compliance and uphold user trust.

    With Your Consent. With your consent, we may use, disclose and share your Personal Information in ways not specifically described in this Privacy Notice.

  5. We frequently make content or services from other websites available to you from links located on the Services. We may present links in a format that enables us to keep track of whether these links have been followed. This Privacy Notice applies only to the Site, the App and the Services. We do not exercise control over third party services or other websites that provide information, banners, advertisements or links. Your interactions with these third party services are governed by the privacy policy of the company providing it. These other websites and services may place their own cookies or other files on your computer’s browser, collect data or solicit Personal Information from you. Other websites and services follow different rules regarding the use or disclosure of the Personal Information that you submit, and the collection and use of such information, and access of any third party websites are subject to such third party’s privacy policy. We encourage you to read the privacy policies and other terms of such third parties before using their services.

  6. Accuracy and Security

    Personal information you provide to us should be relevant to the purposes for which it is used and, to the extent necessary for those purposes, accurate, complete, and up to date.

    We use a variety of industry-standard security technologies, measures and procedures to help reasonably protect Personal Information about you from unauthorized access, use, or disclosure and train our employees and affiliates on privacy and security issues. However, we cannot guarantee that unauthorized parties will never be able to overcome those measures or use your Personal Information for improper purposes, and we do not promise that Personal Information about you or private communications will be protected from unauthorized disclosure or use. Please refer to the U.S. Federal Trade Commission’s Website for information on how to protect yourself from identity theft.

  7. Children

    While we allow teenagers to use our Services, only parents, legal guardians, or other adults, persons 18 or older, are allowed to make purchases through our Services; and children under 18 are not authorized to make use of our Services.

    We do not knowingly collect or use information from children under 18 through the Services. If a parent or legal guardian becomes aware that their child under the age of 18 has provided information to us through the Services, the parent or legal guardian, should contact us at [email protected], and with proper authentication, has the right to review the Personal Information we may have collected and stored about their child and request deletion of such Personal Information. We will use commercially reasonable efforts to delete the information. Please keep in mind that a request to delete such information may limit your or the child’s access to all or a portion of the Services. We urge parents to monitor their children’s use of all digital media.

    We keep your data on your behalf and for your benefit. To exercise the rights detailed in this Privacy Notice, please see the “Methods for Submitting Requests and Our Response to Requests” section of the Privacy Notice below. If you cancel your Account or request us to delete your information, we will comply with such requests in compliance with applicable law.

    This section applies to you only if you are a California resident pursuant to the California Consumer Privacy Act, as amended (“CCPA”).

    “Sale” or “Share” of Personal Information or Targeted Advertising

    We share your Personal Information with third parties for the purpose of cross-contextual behavioral advertising purposes (e.g., targeted advertising and remarketing). In addition, while we do not sell your Personal Information as the concept of “selling” is traditionally understood as being the exchange of something for money, under the CCPA our practice of sharing of your Personal Information with certain of our corporate affiliates may be considered a sale of your Personal Information. Therefore, you have the right to opt out of such selling and sharing.

    In some U.S. states, you may also have the ability to opt out by enabling the Global Privacy Control setting within the browser that you use to access our Services, depending on whether the browsers and/or browser extensions you use support such a signal.     In addition to those rights set forth in the U.S. State Privacy Rights section below (as applicable), California law permits residents to request certain details about how their “personal information” (as defined in California Civil Code Section 1798.83) is shared with third parties for their direct marketing purposes. We may from time to time elect to share certain Personal Information about you with third parties for those third parties’ direct marketing purposes. Residents may, under certain circumstances, obtain the categories of personal information shared and the names and addresses of all third parties that received personal information for their direct marketing purposes during the immediately prior calendar year. Only you or an authorized agent (if and only as permitted under applicable law) that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. Upon receipt of a request, we may ask you for additional information to verify your identity, or if you have a registered agent act on your behalf, we have the right to authenticate such agent’s authority to act. Without limiting the foregoing, the verifiable consumer request must:

    • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

    • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

    We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

    Subject to our ability to verify your identity, we will respond to your request within the timeframe required under applicable law. If we require more time, we will inform you of the reason and extension period in writing. Notwithstanding, we will respond to any requests to opt out as soon as feasibly possible, but no later than the timeframe required by law.

    The delivery of our response may take place electronically or by mail.

    Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

    We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a reasonable fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

    Authorized Agents

    The above rights are only exercisable by you where the applicable law grants you the right being exerted and where no exception or exemption under applicable law applies. You may also have an agent (if and only as permitted under applicable law) that you authorize to act on your behalf. If you have an agent act on your behalf, we have the right to authenticate such agent’s authority to act. You must provide an authorized agent with signed written permission that authorizes the agent to submit a request on your behalf, and we may require that you verify your identity directly with us. Alternatively, an authorized agent that has been provided power of attorney pursuant to California Probate Code Sections 4000-4465 may submit a request on your behalf. To exercise the rights described herein (only to the extent applicable), you may submit a request to us by the methods set forth under the “Methods for Submitting Consumer Requests and Our Response to Requests” section above.

    Right to Appeal

    If we deny your request to exercise any of the data rights described above, under applicable law, you may have the right to appeal our decision within a reasonable period of time after your receipt of our decision.

We will respond to an appeal within the timeframe required under applicable law. Our response to your appeal will inform you of decisions and actions in response to your appeal, including an explanation of the reasons for the decisions.

  11. International Transfers of Personal Information

    We are based in the United States. As a result, Personal Information that we collect in and through the Services and on the Site or App may be transferred to our U.S. offices. In addition, we may work with third-party service providers in the U.S. and in other countries to support our business activities. Thus, Personal Information may be transferred to, stored on servers in, and accessed from the United States and countries other than the country in which the Personal Information was initially collected. By accessing, receiving, or using the Services or by providing consent to us (where consent is required by applicable law), you specifically acknowledge and agree that information may be transferred outside of the country from which you access the Services (including, for example, to the United States, Canada, and India) and that such countries’ data protection and related laws, regulations, and rules may be different than, and may not be as protective as, those of the jurisdiction from where you access the Services.     We keep Personal Information related to your Account for as long as needed to fulfill the purposes for which it was collected, to provide our services, to deal with possible legal claims, to comply with our legitimate business interests and/or as otherwise required by applicable laws. Thereafter, we either safely delete Personal Information about you or de-identify it. Please note that even if you request the deletion of Personal Information about you, we may be required (by law or otherwise) to retain the Personal Information and not delete it. However, once those requirements are removed, we will safely delete Personal Information about you in accordance with your request.

    The following section of this Privacy Notice only applies to Canadian residents. Under Canadian laws and regulations, you may have certain rights in regard to our collection of Personal Information (subject to all exemptions and exceptions, as applicable). These rights include:

    You are the sole authorized user of your Account, and you agree not to share your password, account information or access to the Services with any other person. Each user is required to have a separate username and password. You are responsible for maintaining the confidentiality of any log-in, password, and Account number provided by you or given to you by us for accessing the Services. You are solely and fully responsible for all activities that occur through the use of or under your password or Account, even if not authorized by you. We have no control over the use of any user’s Account and expressly disclaims any liability derived therefrom. Should you suspect that any unauthorized party may be using your password or Account or you suspect any other breach of security, you agree to contact us immediately.
